General title

This Digital Millennium Copyright Act policy ("Policy") applies to the pornhub.com website ("Website" or "Service") and any of its related products and services (collectively, "Services") and outlines how this Website operator ("Operator", "we", "us" or "our") addresses copyright infringement notifications and how the owner of the copyright ("you" or "your") may submit a copyright infringement complaint.

If you believe that copyright material has been infringed, we encourage you to notify us. We will respond to all valid requests. This policy is intended to comply with the Digital Millennium Copyright Act of 1998.

Infringement notification

If you are a copyright owner or an agent thereof, and believe that material available on our Website infringes one or more of your copyrights, we encourage you to notify us by using the contact details below providing the following information:

Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works. Identification of the infringing material and information reasonably sufficient to permit us to locate the material. Please submit the URL in the content to help us locate the material quickly. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. A physical or electronic signature (typing your full name will suffice). Failure to comply with all of the requirements of the DMCA may render your notification invalid.

Counter-notification

A user who receives a copyright infringement notification pursuant to the DMCA may make a counter notification with our Designated Agent containing the following information:

Your physical or electronic signature. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the Service Provider may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

If a counter-notice is received by the Designated Agent, we may send a copy of the counter-notice to the original complaining party informing that person that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at our discretion.

Changes and amendments

We reserve the right to modify this Policy or its terms relating to the Website and Services at any time, effective upon posting of an updated version of this Policy on the Website. When we do, we will revise the updated date at the bottom of this page. Continued use of the Website and Services after any such changes shall constitute your consent to such changes.
